SMS Opt-In & Consent
Last updated: August 21, 2026
1. Program Summary — “Deally Order & Rewards Texts”
Deally is an online ordering and loyalty platform used by independent restaurants. Restaurants on Deally text their own customers through the platform. There are two kinds of messages:
- Transactional — order-related texts, where a restaurant has them enabled, and the secure payment link a customer asks for when a restaurant offers ordering over its phone line. These follow from the order the customer placed or the link the customer requested; they are not marketing and they create no marketing consent.
- Loyalty and promotional — reward offers, birthday gifts, expiring-points reminders, win-back offers, and welcome or tier messages. These are sent only to customers who explicitly opted in to that restaurant by checking the consent box described in Path B below.
Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. Consent to marketing messages is never a condition of purchase; it is recorded for one restaurant at a time, together with the mobile number it was given for. Mobile numbers and opt-in status are never sold or shared with third parties or affiliates for their own marketing.
2. Opt-In Path A — Online Checkout (transactional only)
A customer visits a restaurant's ordering page on Deally — for example https://order.deal-ly.com/joes-diner — adds items to the cart, and opens Checkout. The checkout form asks for a mobile number under a visible note that reads:
We may text you about this order. Msg & data rates may apply. We never send marketing texts unless you opt in.
The phone field creates no marketing consent. A number given at checkout is used for that order only. Leaving checkout, or ordering again, never opts the customer in to anything.
Where the checkout page also offers creating an account, it shows the separate unchecked marketing checkbox described in Path B below. Ticking that box — and nothing else on this page — is what opts a customer in. The checkout page also links the Terms of Service and the Privacy Policy.
3. Opt-In Path B — The Marketing Consent Checkbox (the only way to opt in)
When a customer creates an account with an email address and password, or joins a restaurant's rewards program, on that restaurant's ordering site and provides a mobile number, the form shows an unchecked checkbox labeled (signing up with Google or Apple shows the same box once a mobile number has been entered):
Text me rewards and offers from this restaurant. Message frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to unsubscribe.
- Marketing texts are sent only when the customer actively checks this box. It is never pre-checked, and no other action on the site opts anyone in.
- The consent is recorded for that restaurant only, with a timestamp, the surface it was given on, and the mobile number it was given for: ordering from a second restaurant on Deally does not opt the customer in to its marketing.
- Because the consent is tied to that number, changing the mobile number on the account ends it — the customer has to tick the box again for the new number before any further marketing text is sent to it.
- Consent is never a condition of purchase — customers can order without it.
- The same consent control is on the account page of the restaurant's ordering site: a customer can turn marketing texts on there for the restaurant whose site they are on, and off for any restaurant they have opted in to.
- Consent can be withdrawn at any time: turn the preference off on that account page, or reply STOP to any message (Section 5 — STOP is platform-wide).
4. Opt-In Path C — Phone Orders (transactional only)
Where a restaurant offers ordering over its phone line, a caller can verbally ask for a secure payment link and give a mobile number on that call. One link is texted to the number provided. This path sends no marketing messages and creates no marketing consent.
5. Opt-Out and Help
- STOP — reply STOP to any message to stop all further messages. Deally sends from a single number, so STOP stops texts from every restaurant on the platform — order-related texts included — not just the restaurant that sent the message. A single confirmation is sent, and nothing after it.
- To stop marketing from one restaurant only, and keep everything else, turn that restaurant's preference off on the account page of its ordering site instead of replying STOP. The restaurant whose ordering site the customer is on is always listed there.
- HELP — reply HELP to any message for the automatic help reply with program details and contact information, or email us at the address below.
- Carriers are not liable for delayed or undelivered messages.
